2006/735 - LAND WEST OF STRATFORD ROAD, SOUTH OF HASLUCKS GREEN ROAD AND 63 HASLUCKS GREEN ROAD, SHIRLEY - SHIRLEY ADVANCE LLP & McLAGAN - MIXED USE DEVELOPMENT COMPRISING OF AN ANCHOR FOODSTORE, RETAIL UNITS AND BASEMENT CAR PARKING; 190 APARTMENTS (INCLUDING 50 RETIREMENT); FOOTWAYS, SERVICE AREAS, REVISED HIGHWAY JUNCTION, NEW ACCESS ARRANGEMENTS, LANDSCAPING WORKS TO SHIRLEY PARK; DEMOLITION OF PROPERTIES AND CHANGE OF USE OF 63 HASLUCKS GREEN ROAD TO B1 OFFICES; AND ACCOMMODATION WORKS.

The Head of Planning Services agreed to amend the report to members by inserting the word "large" between "another" and "supermarket" in the section that detailed the representations made by Councillor H Allen on page 9.

The Head of Planning Services clarified the recommendation by confirming that the following be added to the end of the recommendation "and that, subject to the Secretary of State choosing not to intervene in the determination of the application, that planning permission be granted."

Members resolved that:

the Secretary of State be notified that the Council is of a mind to grant planning permission for the proposed development, subject to:-

(a) The applicants entering into a Section 106 Agreement to achieve the following:
i. The payment of £500,000 towards park improvements,
ii. Provision to ensure public access along the new pedestrian routes & public squares.
iii. The management and operation of the basement car park (opening times, charging regime) be subject to the agreement of the Council.
iv. Service yard management plans are prepared and implemented in accordance with details to be submitted.
v. Facilities to enable the provision of services for the mobility impaired are provided in accordance with details to be submitted & approved.
vi. That 56 units on the site excluding block F are provided as affordable housing.
vii. That a commuted sum of £431,232 is paid in lieu of providing affordable housing in Block F.

And

(b) Conditions 1-45 as amended.

And that, subject to the Secretary of State choosing not to intervene in the determination of the application, that planning permission be granted.


For the proposed development subject to a series of conditions, the applicants entering into a Section 106 Agreement, and the Secretary of State choosing not to intervene in the decision making process.

Condition 3 16 to be amended to read '...replacement sports pitch to meet Sport England standard...'include the translocation of some of the oaks trees from the ring of oaks as part of the landscaping scheme.

Condition 25 to be amended to include the provision of the sports poitch to Sport England's stanadard.

Condition 24 to be amended to read ‘…The development hereby approved shall not be occupied until a scheme of public art that, where possible, uses the oak tree lost in the development, has been provided….'

A further Condition 45 was added to read…'That residential properties backing onto the store have something softening the impact of the wall, such as artwork…'secure an amendment to the treatment of the northern elevation of the foodstore to provide visual relief.

Councillors Cox, Hedley, and Windmill wished it to be recorded that they voted against the recommendation.

2006/919 - LAND TO REAR OF SARACENS HEAD PUBLIC HOUSE, SHIRLEY PARK, STRATFORD ROAD, SHIRLEY - SHIRLEY ADVANCE LLP & McLAGAN - CONSTRUCTION OF TEMPORARY SHOPPERS' CAR PARK TO PROVIDE 160 SPACES

Members resolved to grant planning permission subject to application 2006/735 not being called in for determination by the Secretary of State.

Condition 3 be amended to include that the provision of the sports pitch to be to Sport England's specification.

Councillor Cornock was not in attendance and Councillors Cox, Hedley, and Windmill wished it to be recorded that they voted against the recommendation.

01Councillors Windmill and Cox advised that neither they, nor Councillor Hedley, took any part in the campaign (and therefore retained their independence) run by Lorely Burt through the local newspaper despite reference to Councillor Cox having 'published and promoted' the material on behalf of the Liberal Democrats.
02Mr Wise, Ms Leach, Mr Cawte, Miss Edinburgh, Mr Sayer, Dr Thompson, Councillors H Allen, A Hodgson, S Slater, L Cresswell, and J Gandy all spoke in opposition to the application whilst Mr Birch, Mr Barnes, Mr Bavin, and Mr Storey all spoke in support. Mr Kund and Mr Watts had requested to speak but neither were in attendance.
03Mr Wise and Councillors A Hodgson and S Slater spoke against the application whilst Mr Birch spoke in support. Councillor H Allen had requested to speak but was not in attendance.
