2001/1943 - LAND AT J4 M42, STRATFORD ROAD, SOLIHULL - SHIRLEY ESTATES (DEV) LTD - MOTORWAY SERVICE AREA - (A)Had the Council still been able to determine the application it would have been refused for the reasons set out in the report with reason 2 amended to include reference to a shortfall in parking spaces. It was also resolved that:- (B)Evidence for both this appeal and that that relates to the proposals at Catherine-de-Barnes (the re-opened inquiry) is at an advanced stage of preparation on all sides. On the advice of Counsel it may be necessary to amend or vary the arguments to be advocated at the inquiry. This may need to occur at short notice and therefore it is recommended that the authority to vary or amend the grounds upon which both appeals are to be contested, is delegated to the Head of Design and Development; and (C)In both appeals it has been identified that if the Secretary of State were to grant planning permission, off site improvements or other requirements may be necessary. These may not be secured by conditions and therefore a Section 106 Agreement would be required. Therefore it is recommended that authority to enter into a Section 106 Agreement is given.
