Agreed that the proposed scheme from Shirley Advance satisfies the Development Agreement and so;
Authorised Shirley Advance to submit a planning application which would satisfy the requirement of the statutory process;
Delegated to the Cabinet Member for Resources the function of determining whether it is appropriate to make a compulsory purchase order or orders under the relevant statutory powers, including Section 226 of the Town and Country Planning Act 1990, and Sections 239 and 240 of the Highways Act 1980 for the acquisition of all rights and interests in the land shown edged red on the plan attached at Appendix K to the report, together with such other land as may be required for related highway purposes and if thought fit, resolving to make such compulsory purchase order or orders following any resolution to grant planning permission for the proposed scheme; and
Authorised Officers to evaluate the new proposals put forward by GC Shirley Ltd and to report back to Cabinet on those proposals. |
To consider whether proposals submitted by Shirley Advance to Solihull Council as landowner in respect of the “New Heart for Shirley” satisfy the key elements set out in the Development Agreement |
