286Cab04 Council Results 2003/04 The Cabinet:-

Approved the Council Results 2003/04, in order that the statutory publication date of 30 June 2004 can be met and refer the results to the next Council meeting for formal ratification;

noted the generally improving performance of the Council; and

endorsed the actions for improving indicators which are in the worst quartile of have declined by more than 10%.

As a result of the Council's improved Comprehensive Performance Assessment rating, the Council is no longer required to produce a separate Best Value Performance Plan, only publish our performance indicator results (and targets).  The Performance Management Panel have used this freedom to produce a Council Results 2003/04 document, which focuses entirely on outturn performance.  This document will be followed by the updated Council Plan, which will be informed by the information contained in Council Results 2003/04. 05 July 2004  
287Cab04 The Top 40 Performance Indicators - End Of Year Results The Cabinet noted the performance of the Council in respect of the Top 40  performance indicators for the year 2003/04 and further actions taken to improve performance. To ensure sytematic management, recognition and monitoring of performance. 05 July 2004  
288Cab04 Final Accounts 2003/04 The Cabinet :-

approved the virements outlined in para 6.3.1of the report to comply with accounting requirements;

approved the 2003/04 final position in General Fund revenue accounts shown in Appendix B and C and the Capital Accounts shown at Appendix D of the report;

approved the contribution from Contingency as outlined in para 6.3.4 of the report and establish a new contingency of three and quarter million pounds for 2004/05 to be funded from working balances,

approved the funding of the Education and Children’s Service as outlined in para 6.3.4 of the report;

approved the carry forward of additional funds outlined in para 6.5.2 of the report to be considered by the Cabinet Portfolio holder for Resources totalling £0.496M;

noted the total effect on the Council’s working balances shown at Appendix C in the report;

approved the capital rephasing proposals, outlined in para 6.7.2 of the report; and

noted the requirement to produce a Statement of Internal Control and refer its approval to General Purposes Committee prior to Full Council.

To present the final accounts for Revenue and Capital expenditure for 2003/04; seek approval for revenue carry forwards and capital rephasing; and refer to General Purposes Committee formal assessment of the final accounts including the newly required Statement of Internal Control. 05 July 2004  
289Cab04 Care Trust Partnership [Governance Issues] The Cabinet :-

noted the recommendations and the decisions of the Cabinet Member for Social Care and Health in relation to the Care Trust Partnership Project;

asked officers to arrange a joint meeting with the Health Scrutiny Board to which the Chairman and Chief Executive of the PCT would also be invited; and

agreed to determine the matter of Governance at a future cabinet when the final recommendations of the Health and Social Care Partnership Board are available.

To enable Cabinet to give preliminary consisderation to issues of Governance with a view to securing an understanding of the issues and a basis for  final decision making at a future meeting preparatory to further work and decisions in relation to the Care Trust Partnership Project within the Council Plan. 05 July 2004  
290Cab04 North Solihull Regeneration The Cabinet :-

approved the project plan for the current phase of the North Solihull Regeneration Project; and

noted the progress made in implementing the consultation strategy for the current phase of the North Solihull Regeneration Project.

To seek approval for the project plan for the current phase of the North Solihull Regeneration Project and to report on the progress of plans for consultation. 05 July 2004  
291Cab04 Development of a Learning Village on the Woodlands Site The Cabinet :-

noted the progress made;

agreed the Heads of Terms and endorse the proposals     for a Lease and a Management Agreement which will transfer the site to Solihull College,

noted the need to provide temporary and permanent replacement accommodation for the Education and Children’s Services staff currently located on the Woodlands site, and

delegated the final approval to sign the agreements once complete to the Cabinet Portfolio Holder for Education and Children.

To update Cabinet on the progress being made by Solihull College in developing a "Learning Village" on the Woodlands site and in particular to seek the support of Cabinet in approving arrangements for the transfer of the land and necessary agreements

292Cab04 Property Services Team. The requirements of the Control of Asbestos at Work Regulations 2002. The Cabinet :-

noted the progress to date for the Management of Asbestos as outlined in the report;

approved the management plan as detailed in Appendix "A" to the report and the process for effective management of ACM's as required by the Control of Asbestos at Work Regulations 2002; and

authorised the Cabinet Portfolio Holder for Resources to approve the appropriate training, subject to a further report.

To update on the progress of the asbestos survey and approve the management plan in accordance with the requirements of the Control of Asbestos at Work Regulations 2002. 05 July 2004  
293Cab04 Property Services Team - Water Hygiene Strategy The Cabinet :-

noted the content of the report regarding the Water Hygiene Strategy, and endorsed the offering and tendering of a comprehensive water hygiene monitoring service, to cover all schools and Council owned public buildings,

noted that tenders be opened and the most appropriate accepted by one of the authorised Cabinet Members and:-

approved that the policy document at Appendix ‘A’ to the report be accepted as the formal Council policy for the effective control of legionella within premises, for all Council owned Public Buildings and Schools.

To update Members regarding the Water Hygiene Strategy for Council owned Public Buildings (eg: Libraries, Leisure centres etc) and Schools, and to introduce a new Council Policy regarding minimising the risk of legionella in hot and cold water systems. 05 July 2004  
294Cab04 Waste Disposal P.F.I. The Cabinet :-

noted the latest position of the PFI OBC submission with Coventry City Council, seeking a PFI Credit to fund the delivery of the additional recycling and recovery facilities;

agreed to receive a further report considering detailed financial implications when a decision is received from DEFRA & PRG on the OBC application for PFI Credits;

 delegated authority to the Cabinet Portfolio Holder for Local Services to progress initial project planning work;

following consideration of a further report as set out in (ii) above  delegated to Cabinet Portfolio Holder for Local Services authority for the delivery of the project within a policy and financial framework to be set by Cabinet; and

approved the development of a project plan to deliver the service improvements identified by the PFI submission.

To advise members of the latest position on the P.F.I submission with Coventry City Council and seek delegated authority for the Cabinet Member for Local Services to take forward initial project planning work. 05 July 2004  
295Cab04 The Birmingham City Region The Cabinet: -

noted the progress of the Birmingham City Region; and

endorsed the ongoing development of the City-Region on the basis set out in the report.

To update Cabinet on the progress of the Birmingham City-Region and to seek support for the further development of the City-Region. 05 July 2004  
296Cab04 Gas and Electricity Contracts – Award and Decision Process The Cabinet:

agreed to delegate authority for the award of  utilities contracts to the Cabinet Portfolio Holder for Resources or a delegated officer, the authority will permit the award of the utilities contracts  without the need of the formal Council decision and call in period.

 noted the report to General Purpose Committee in relation to changing the Rules for Contracts and Financial Matters relating to Gas and Electricity Contracting.

To delegate authority when awarding Gas and Electricity contracts to the Cabinet Member for Resources or their delegated officer, without going through the current cabinet report process and call in period irrespective of total contract value. Cabinet will be informed of all actions and decisions via an information report at the next Cabinet meeting following the award of the contract. 05 July 2004

299Cab04 Swallows Meadow Sheltered Housing Scheme The Cabinet:-

Approved a bid to the Department of Health for funding for an extra care-housing scheme in accordance with the principles set out in para. 17.4.1 of the report;

Agreed to delegate authority to the Chief Executive to negotiate the sale of a lease for the existing Swallows Meadow site to Solihull Care Housing Association;

Agreed to earmark the capital receipt from the lease for the development of social housing; and

Approved a Council contribution to the scheme of £0.250M in respect of affordable housing commuted sums from new housing developments.    

To seek approval for the submission of a bid for funding to develop an extra care housing scheme and to clarify the Councils financial contribution to the proposed scheme.     05 July 2004  
300Cab04 Building Schools for the Future (BSF) - consideration of draft submissions, governance and costs The Cabinet :-

approved  the progress on the draft Strategic Business Case document and the Terms of Reference for the BSF Board;

approved the interim proposal to initially proceed with a limited Local Education Partnership pending further consideration;

approved expenditure up to £500,000 from the Education contribution to the Landlord Maintenance Pool to fund the preparation and submission of the BSF proposals and replace this funding from within the Education Corporate Capital Programme ; and

 

agreed to authorise the Cabinet Portfolio Holder for Education and Children and Director as appropriate of Education and Children’s Services to continue to take all necessary steps to progress the project and report back to their next meeting, and authorise the Overview and Scrutiny Management Board to scrutinise the BSF Project and proposals at a specially convened meeting.

To receive an update on progress on the BSF project. To consider the following draft documents: -

1. Strategic Business Case (SBC) incorporating Education Vision

2. Terms of Reference for a BSF Board

3. To consider the formation of a Local Education Partnership (LEP)

4. To approve arrangements  for Scrutiny by Overview and Scrutiny Management Board.

5. To approve expenditure of up to £500,000 for preparation and submission of BSF Proposals, to be funded from the  Education contribution to the Landlord Maintenance Pool.

6. To authorise Officers to progress all matters to achieve the necessary  Government approvals.

301Cab04 Balsall Common Bypass Improvement Line Blight Notice - The Willows, Hob Lane, Balsall Common. The Cabinet made a number of decisions concerning the acquisition of property and funding method. To approve the recommendation of the Cabinet portfolio holder Transport and Highways that the acquisition of the property be approved, and to approve the method of funding. 05 July 2004 Private
