Environmental Information and the Re-Use of Public Sector Information
Public Protection holds a range of environmental and other information as defined by the Environmental Information Regulations and the Freedom of Information Act.
Where a request is made for information the charges, if any, will normally be based on the cost of reproduction only. However, the Solihull MBC will retain the copyright on the information supplied and the use and re-use of the information will be restricted for the purposes of
- research,
- private study,
- criticism,
- review
- news reporting.
Other re-use, including that by any person in connection with property transactions, would be subject to specific permission being granted by the copyright holder in the form of a licence and a charge may be made in accordance with the Re-Use of Public Sector Information Regulations 2005.
The following information is available for re-use
- Air quality data
- Information relating to the state of land pertinent to Part IIA of the Environmental Protection Act 1990
- Information relating to environmental noise including noise mapping data
- Noise registers kept in connection with Noise Abatement Zones made under the Control of Pollution Act 1974
- Information relating to Smoke Control Orders made under the Clean Air Acts
- Information relating to industrial premises and processes relating to the Pollution Prevention and Control Regulations.
- Registers of licences issued under animal welfare legislation.
- Register of cooling towers and evaporative condensers
- Register of food business establishments made under EC Regulation 882/2004 (Article 6(2))
- Information relating to the “Scores on the Doors” food hygiene rating scheme
Charges
All public Registers can be viewed in person free of charge.
Any request for supply of hard copies of information will be charged at standard rate for A4 photocopies – currently 43p per page.
Note:
Any re-use of the information for commercial purposes (including that in connection with a property transaction) would be subject to a licence and the payment of the appropriate fee (see below).
Re-use of Information Public Sector Information Licences
a) Basic Licence (information used internally to the organisation making the request or the standard information associated with a property transaction) - £57.00 per request
b) Limited Licence (limited external use, limited commercial value, e.g. Air Quality Assessment, Pollution Prevention & Control Register)
If research time exceeds 2 hours an additional hourly rate will be applied - £116.00per request
c) Full Licence (information provided for re-use, commercially valuable, e.g. Landfill Site Register, Food Business Register) - £306.00 per request
d) Major Re-use Licence (where there is a considerable commercial value in the information requested) Each case to be negotiated separately on a case by case basis
An overall fee reduction of up to 25% may be applied if multiple licences are required by customers who regularly request information for re-use.
