Licensing - Alcohol
Information about licensing.
The Licensing Act 2003 requires a Premises Licence to be in place at a venue, indoors or outdoors, for any of the following activities:
- The sale or supply of alcohol
- The provision of regulated entertainment (including theatres and cinemas)
- The sale of hot food and/or drinks between the hours of 11pm and 5am
In addition, anyone involved with the sale or supply of alcohol will require a Personal Licence.
The only exception to this is for those persons applying to run a Temporary Event, where a Temporary Event Notice has been served on the Licensing Authority and the Police. No other form of licence is required when a Temporary Event Notice is in force.
The Act also recognises that premises to which public access is restricted, and alcohol is supplied other than for profit, are operated in a different manner to, and will present different issues from, a commercial enterprise selling to the public. Traditionally qualifying clubs such as registered members clubs, Royal British Legion Clubs, sports clubs and social clubs have been treated differently for these reasons, and this is preserved under the Club Premises Certificate. Although subject to the same application processes, the grant of a Club Premises Certificate entitles the qualifying club to certain benefits.
Solihull Council is the Licensing Authority for the district and is required, under Section 5 of the Act, to publish a "Licensing Policy" every 3 years. The policy will incorporate the 4 Licensing Objectives, which all applicants must address:
- The prevention of crime & disorder
- Public safety
- The prevention of public nuisance
- The protection of children from harm
