Gambling Act 2005

Local authorities have the responsibility of licensing gambling premises, and the Gambling Commission issues gambling operators licences and personal licences for individuals employed in gambling related industry.

The Act regulates licensable premises, licences, notices, permits and registrations for the following:

  • Casinos
  • Bingo premises
  • Betting premises
  • Track betting
  • Adult Gaming Centres
  • Family Entertainment Centres
  • Club gaming permits
  • Prize gaming and prize gaming permits
  • Temporary Use Notices
  • Registration of small society lotteries

The Act creates three licensing objectives, which are central to the new regime. In applying for a licence, permit etc, applicants will have to show how they will meet these objectives, which are:

  • Prevent gambling from being a source of crime and disorder
  • Ensure that gambling is conducted in a fair and open way
  • Protect children and other vulnerable persons from being harmed or exploited by gambling

Applications for premises licences under the Act can now be made to this Authority. However, you will need to apply to the Gambling Commission for an Operator's Licence before doing so.

The Gambling Act 2005 requires Licensing Authorities to prepare and publish a 'Statement of Principles'. This document sets out how the Licensing Authority intends to promote the licensing objectives when considering applications made under the Act. It will be reviewed as necessary, at least every three years.
