Gaming Machine Licence
A gaming machine licence is required in respect of premises providing amusements with prizes by way of machines.
The most common applications of gaming machines are those commonly referred to as 'fruit machines' and 'one-armed bandits' which make small payments. Typically these machines would be found in amusement arcades, motorway service stations as well as pubs and clubs.
Gaming machines are defined in the Gambling Act 2005 as a machine which is designed or adapted for use by individuals to gamble (whether or not it can also be used for other purposes)
A licence is not required where the machine in question is based only on a game of skill (for e.g. quiz machines), or is an amusement only machine and in either case no money or token is paid out by the machine.
It is an offence to make a gaming machine available for use unless it is in accordance with one of following :
-
an operating licence
-
a family entertainment centre gaming machine permit
-
a club gaming permit or club machine permit
-
a licensed premises gaming machine permit
-
a notification made to the licensing authority by the holder of a premises licence under the Licensing Act 2003 that they will be operating 1 or 2 gaming machines
-
the exception for travelling fairs to operate category D gaming machines
-
there is no prize or the prize is limited to a value which does not exceed the amount paid to play
