Licensing Act 2003

The 7th February 2005, was designated as the 'First Appointed Date', under the Licensing Act 2003 and marked the beginning of the transitional period in respect of those applications which must be made for Premises Licences, Club Premises Certificates and Personal Licences.

About the Act

The Licensing Act 2003 marked the end of existing, outdated licensing regimes and introduced a single, modern, flexible and responsive system of licensing encouraging greater opportunities for leisure in a safe and pleasant environment.

Applicants must outline the steps they will take to promote the four licensing objectives at their place of business. These are:

  • The prevention of crime & disorder
  • Public safety
  • The prevention of public nuisance
  • The protection of children from harm

A copy of the complete application, including all attachments, must be submitted to each of the Responsible Authorities for their scrutiny.

Details of all applications received by the Council are entered onto a Public Register, which may be inspected at any reasonable time by appointment, or via the on line register of applications.

In respect of any application made to the Licensing Authority, Interested Parties and Responsible Authorities may make relevant representations should they wish to do so. An Interested Party can be any one of the following:

  • A person living in the vicinity of the premises
  • A body representing persons who live in that vicinity
  • A person involved in a business in the vicinity of the premises
  • A body representing persons involved in these businesses

Any of these people may specifically request a representative to make representations on their behalf. This can include a legal representative, a friend, a Member of Parliament or a Ward Councillor.

A relevant representation is classed as one which:

  • Relates to the effect of the grant of the licence on the promotion of one or more of the licensing objectives
  • Is made within the 28 time period specified
  • Is not frivolous, vexatious or repetitious
