A Chelmsley Wood man has been ordered to pay out over £600 after allowing his dog to foul on Council land.

On Thursday 26 November 2009 at Solihull Magistrates Court, Mr Neil Cox of 45 Gonville House, Dove Way, Chelmlsey Wood B36 OTH was, in his absence, found guilty of failing to remove dog faeces from the land around Gonville House.

This is an offence of the Fouling of Land by Dogs (Solihull) Order 2007 made under Section 67 of the Clean Neighbourhoods and Environment Act 2005.

Mr Cox was witnessed allowing his dogs to foul on council land around Gonville House on two occasions. He was offered the opportunity to pay a Fixed Penalty of £75, however when he failed to pay, legal action was instigated.

He was fined £265, £15 Victim Surcharge and required to pay full costs of £402.

Cabinet member for Safer Communities, Councillor Mrs Holl-Allen said: “Everyone deserves to live in a clean and pleasant area. Most dog owners in Solihull are responsible and carry a plastic bag with them. I hope that this case illustrates that we will not tolerate dog fouling in our borough and we will not hesitate to take action against offenders.”
