What is a 'private street'?
Road adoption is a term used to describe the Council taking ownership of a 'private street'.
A 'private street' is a road, which is not maintained at public expense. This means that we, as a highway authority, is under no obligation to carry out repairs or clean the street, even though it could be a public right of way to which highway and traffic law can be applied.
How does a 'private street' become adopted?
New roads that have been constructed in accordance with the our guidelines are normally adopted by way of an agreement between the developer and us under section 38 of the Highways Act 1980. Existing roads will not normally be adopted unless they are brought up to current standards by the owners of the road.
Will the Council maintain an unadopted road?
We are only responsible for the routine inspection and maintenance of all adopted roads. These inspections are carried out by a team of Neighbourhood Co-ordinators on a scheduled basis to identify any essential works that may be required to maintain the highway in a safe condition. The maintenance of unadopted roads is the responsibility of the private landowner.
