Duty to Consult on the removal of street trees

The 'Duty to Consult' gives people an opportunity to express their views on the proposed removal of street trees in their area. 

All highway authorities in England have a legal duty to consult with individuals who may be affected by the proposed removal of a tree or trees.  

This ensures the decision-making process is more transparent and considers the views of local people.  

The duty applies to trees in urban areas, known as ‘street trees’, that are:  

  • within scope of the legislation  
  • where the proposed removal is for non-exempt reasons
